Terms and Conditions

Please read these conditions carefully. When making a reservation with Beaucette Marina Ltd, you are entering into a legally binding contract, the terms of which are set out in these Conditions.

1. Beaucette Marina Limited Accommodation

The contract for a short-term holiday rental will be between Beaucette Marina Limited (referred to as “us” or “we”) and the person making the booking and all members of the holiday party (referred to as “you” or “your”) in the following booking conditions, the laws of Guernsey will govern the Contract. The contract of hire is not effective until we have received the deposit. The contract will be subject to these booking conditions, and must be complied with. The party leader must be at least 21 years of age at the time of the booking and the booking form must list names, and ages of the children in your party. ‘Property/properties’ refers to shepherd huts and/or campervan pitches as appropriate to the text.

2. Duration and times of lettings

You should not arrive before 3pm on the commencement date, and leave by 10:30 am on the day of departure. Failure to do so may result in you being charged a fee of £100. You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period is short-term for the period of the booking and does not create any other legal relationship.

3. Booking Procedure

The procedure to make a booking is to request a booking by completing and submitting the booking form and paying the required non-refundable deposit in full. When this is received and checked to be accurate and complete we will confirm the booking and the contract between us is in place.

The confirmation of a reservation shall not render us liable in the event that the property is unavailable for occupation during the period reserved and no contract will arise between us and you otherwise than in accordance with the following provisions of these terms and conditions.

4. Booking

All requests to book a stay in one of our properties the booking details on our booking system on our website. The Booking form must be fully completed by you and must be accompanied by payment of a holiday deposit which is non-refundable. The amount of the booking deposit shall be as follows:

4.1. If the booking is submitted 8 weeks or more before the commencement of the requested holiday letting period – 30% of the full amount payable in respect of the letting; or

4.2. If the booking is submitted less than 8 weeks before the commencement of the requested holiday period – 100% of the full amount payable in respect of the whole of the letting period.

When the booking request is accepted, the booking fee will be retained by us and treated as a payment on account of the amount payable in respect of the letting. In the event that we decline a booking request, the full amount of the booking fee will be refunded to you.

5. Acceptance of an application.

The contract between us and you for the letting of the property shall arise upon us giving written confirmation of acceptance of your application sent electronically to the email address provided by you in the booking form or upon us having obtained clear funds in respect of the booking fee whichever is the later.

6. Payment

The payment for the full amount of the letting, less the deposit paid (see Clause 4) shall be paid on or before the “due date” namely:

1. In a booking in which clause 4.1 applies, not later than 8 weeks before the commencement of the letting; or

2. In a booking to which 4.2 applies, 100% of the booking fee is payable on application.

3. VAT(or equivalent) is not currently payable in Guernsey on the rental charge of the property

7. Failure to pay

Non-payment of the sum payable under clause 6 by the due date may be treated as a cancellation of your booking and we will be entitled to re-let the property without reference to the client. The terms as to payment in clause 8 thereafter apply.

8. Cancellation

ALL APPLICANTS ARE ADVISED TO TAKE OUT PERSONAL HOLIDAY CANCELLATION INSURANCE.

Any request to cancel a booking must be made in writing to us. You shall remain liable for all the payments due in respect of the reservation whether or not they have been paid at the time of the cancellation. We will use our reasonable endeavours to re-let the property in respect of the cancellation period. If we are successful, you will be refunded the difference between the monies you have paid less the sums receivable from the re-letting after deduction of all costs and expenses incurred by us which shall include an administration fee of 5% of the total booking fee.

9. Changes

We reserve the right to amend the price quoted in a brochure, online or other communications due to errors or omissions. In such circumstances we will contact you as soon as we become aware of an increase in charges. If you do not wish to pay the increase you shall be entitled to cancel the reservation and receive a full refund for all monies paid in respect of the reservation providing notice of cancellation is given in accordance with the provisions of clause 8 and within 7 days of you receiving notice of the amendment to the price to be charged from us.

10. changes to bookings

We will consider any request to change dates after confirmation has been issued. We reserve the right to charge an administration fee of £25 in the event a change of booking is made.

11. Occupancy and the use of property (Shepherd hut)

The maximum number of persons permitted to stay (a) in a four berth shepherd hut is a total of two adults and two children aged 12 or less (age at the time the holiday is taken) and (b) in a two berth shepherd hut is two adults. We reserve the right to refuse admittance if this condition is not observed. Any persons other than members of your party must not use the property in any way without specific prior written consent from us.

12. Care of property

Beaucette Marina is described as the most peaceful and beautiful location in the Channel Islands and your help and support is required to help us maintain and enhance this special place.

You are responsible for the property and are expected to take reasonable care of it and everything within and around the property and be respectful of others.

No speaker/amplified music of any type is permitted anywhere on site at any time – please try to keep general noise to a minimum and respect your neighbours at all times.

Keep noise to a minimum from 10pm – 7am in your accommodation and in the communal areas.

To keep the shepherd hut and its fixtures and fittings in the same condition and repair as on arrival.

Upon departure to strip all beds and leave linen and towels in the bedding basket provided.

To leave crockery and cutlery clean and in the same space you found it.

To leave the BBQ clean ready for the next guests.

To respect our strict recycling policies and process waste and empty bins as directed.

Strictly no smoking in the shepherd huts

To pay for any damage or loss however caused (excluding reasonable wear and tear) incurred during the occupation. All breakages and any damage must be reported to us before the end of your holiday and you undertake to reimburse for the same where necessary.

Not to cause nuisance or annoyance to occupants of any nearby property.

Not to use the property or any part of the Marina for any dangerous, offensive, noxious, noisy, immoral or illegal activities

If in our opinion, any guest is not suitable to continue their occupation of the property because of unreasonable behaviour, damage, or nuisance to other parties, this agreement may be terminated with immediate effect and the guest and party will be asked to leave immediately.

If in our opinion, you have disturbed other guests to the extent that they are due to be refunded any money, the refund made is payable by you.

If damage caused results in the property being unfit for occupation to subsequent guests you shall be liable for the loss of rental income and any other related losses.

A deposit may be requested from bookings at our discretion for reasons above.

13. Vehicles

In respect of all accommodation bookings at Beaucette Marina, one designated vehicle per booking will be included. The vehicle with a Shepherd Hut booking will be allocated a designated parking place for use during the period of the booking. A campervan, with a campervan booking, will have booked an allocated space.

14. Damages and damage deposit

Bookings require a damage deposit of £200.00. Your deposit will be held via your card details submitted when booking. The deposit will be initiated 24 hrs before your arrival time and will be released 24 hrs after the time you leave if no damage has been identified. This includes damage to items, additional cleaning caused by you and your guests. In the event that you or anyone staying at the property during your reservation period causes damage or incurs a need for specialist cleaning services or leaves the property without settling invoices for additional services or supplies received during your reservation period you will be notified in writing of the details of any extra costs incurred within 7 working days after the end of the reservation period and this amount shall be deducted from the Damage Deposit or payment will be required by you.

15. Authorisation

You confirm that you are authorised to sign the booking form on behalf of all persons who will occupy the property and that those persons are aware of the booking conditions. You shall be a member of the party occupying the property and are required to ensure that:

Each member of the party on whose behalf you have submitted the Booking Form is listed on the booking form with his or her full name and children aged 12 or less at the time the holiday is taken.

Each member of the party is aware of and will comply with all rules and regulations published by ourselves in respect of the use and occupation of the Properties;

The number of persons within the party shall not exceed the maximum number of persons permitted to occupy the property. For Shepherd Huts - see Clause 11.

We reserve the right to repossess the property at any time where damage or nuisance have been caused by you or any member of your party and in such event, we shall not be liable to make any refund whatsoever.

16. Liability

This condition sets out our entire financial liability (including any liability for the acts or omissions of its employees, agents, consultants and subcontractors) to you in respect of any breach of this agreement; any use made by you or any third party residing or making use of the property during your period of reservation and any representation, statement or tortious act or omission (including negligence) arising under or in connection with this agreement.

All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this agreement. Nothing in this agreement limits or excludes the liability of us for death or personal injury resulting from negligence or liability incurred by you as a result of fraud or fraudulent misrepresentation by us.

We shall not be liable for loss of profits; loss of business; loss of anticipated savings; loss of personal property or possessions; loss of use of the property or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses in respect of the reservation.

Our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of the conditions of this agreement shall be limited to the monies paid in respect of your reservation under the conditions of this agreement.

Your vehicle or the vehicle of any third party visiting you at the property during the period of your reservation is left on the Beaucette Marina property entirely at the risk of the owner of the vehicle.

17. Force Majeure

In these terms and conditions “Force Majeure” means any circumstances beyond our reasonable control including, without limitation, an Act of God, Fire, Flood, War or Acts of Terrorism.

If by reason of Force Majeure the property is not available at the commencement of the time booked by you or the property is unsuitable for letting at that time, we shall not be deemed to be in breach of contract but shall refund in full to you all fees, charges and any deposit paid in advance by you.

We will not be liable for any other claim for loss or damage by you.

18. General

In the event of any conflict between these booking conditions and any other contents of any brochure or website, these conditions shall prevail.

These terms and the contract between you and us shall be subject to and interpreted in accordance with the laws of Guernsey and the courts of Guernsey shall have exclusive jurisdiction to hear any claim arising from such contract.

Words herein denoting the masculine gender shall, where the context so admits be taken to include the feminine and neuter genders and vice versa.

Words herein denoting the singular shall, where the context so admits be taken to include the plural and vice versa.

By booking you accept the following conditions when renting the property for your holiday use.

To behave in such a manner as not to disrupt the enjoyment of other people staying in the near vicinity or prejudice the reputation of the owner of the property.

Your holiday or that of any third party residing or making use of the property during the period of your reservation in breach of this clause may be terminated immediately and without Compensation or any further obligation. Any damage to facilities arising out of misuse or as a result of negligence and/or failure to follow the instructions herein will be chargeable to you.

When the wood burner is lit, use the fire guard. Make sure the fire is extinguished before going to bed or leaving the property. Only use the wood products provided by us, and do not burn any other materials. Never leave the fire unattended. The use of candles inside or outside the Shepherd Huts is prohibited. Turn off all electrical appliances before going to bed.

19. Regulations and conditions regarding pets

Well behaved and well managed dogs are welcome at Beaucette Marina, all we ask is that you are respectful of other guests’ space and pick up cleanly after your dog.

Shepherd Huts. Only one of our shepherd huts is pet friendly. It is Sark, the YELLOW hut in the photographs and online site map. The other huts are not pet friendly.

Campervans. There is a limit of two dogs per campervan which will be charged at £10 per dog per stay.

Beaucette Marina is an area of outstanding natural beauty with many visitors each year and we request that you immediately clean up after your dog on every occasion it is necessary. Failure to do so will result in an additional charge to your party of £15 for each occasion of default.

20. Security and privacy

Beaucette Marina Limited will ensure that:

Personal data is only used for the legitimate interests and does not unduly prejudice the rights and freedoms of the individual in question.

Personal data will be processed fairly and lawfully in accordance with the Data Protection Act.

They will not process “sensitive” personal data without prior consent from the member.

Access will be granted to computerised personal data in the form of a computerised “printout”, and to manual personal data at its discretion.

Information processed is accurate, relevant, current, up to date and not excessive.

Personal data will be kept only for so long as is necessary for the specified purposes for which it is required.

21. Disclaimer

Please be forewarned that it is possible to catch computer viruses by accessing a web page or by downloading or running an infected program.
